{"id":8507,"date":"2016-02-28T22:00:32","date_gmt":"2016-02-29T03:00:32","guid":{"rendered":"http:\/\/moonrider7.com\/en\/?p=8507"},"modified":"2016-03-29T01:22:48","modified_gmt":"2016-03-29T05:22:48","slug":"huge-gap-between-laws-and-reality","status":"publish","type":"post","link":"https:\/\/moonrider7.com\/en\/2016\/02\/28\/huge-gap-between-laws-and-reality\/","title":{"rendered":"Huge Gap between Laws and Reality"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>Four months have passed since I moved to Syracuse, New York.<\/p>\n<p class=\"p1\">The best part of the\u00a0 experience living here is meeting wonderful people who inspire me.<\/p>\n<p class=\"p1\">\u00a0<\/p>\n<figure id=\"attachment_6810\" aria-describedby=\"caption-attachment-6810\" style=\"width: 254px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-6810 size-medium\" src=\"https:\/\/moonrider7.com\/wp-content\/uploads\/2016\/02\/DSC01111-e1456687092377-254x300.jpg\" alt=\"Arlene Kanter Syracuse University\" width=\"254\" height=\"300\" \/><figcaption id=\"caption-attachment-6810\" class=\"wp-caption-text\">Professor Arlene Kanter<\/figcaption><\/figure>\n<p class=\"p1\">Professor Arlene Kanter is one of them.<\/p>\n<p class=\"p1\">She founded the law school\u2019s Disability Law and Policy Program and she teaches law students and graduate students from all over the university in her courses on disability rights law, international human rights law.\u00a0<\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">In my blog, many times I mentioned the ADA (Americans with Disabilities Act\uff09which changed the lives of people with disabilities in the US. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In addition to the ADA, the US has many other laws that protect the rights of people with disabilities in education, employment, communication, housing, and accessibility etc. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Generally in American culture, one of the common ways people with disabilities enforce their rights is to hire a lawyer, and go to court. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">However, lawsuits can take a long time to resolve. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As Professor Kanter recalls: <\/span><\/p>\n<blockquote>\n<p class=\"p3\"><span class=\"s1\">\u201cI remember that one of the early cases I had involved a young man<span class=\"Apple-converted-space\">\u00a0<\/span>with a disability who had been denied educational<span class=\"Apple-converted-space\">\u00a0 <\/span>services in school. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">When I met him, he was about 20 years old. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">But the case had been gone since he was about 14. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Such cases take too long and courts are not the place to resolve the educational needs of the student. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">But sometimes there is no choice if schools refuse to provide the services to which the student is entitled. \u201d <\/span><\/p>\n<\/blockquote>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">Professor Kanter no longer represents individual clients, but she now works with governments and civil society organizations in many countries to help them develop and enforce disability rights and education laws.<\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-6811\" src=\"https:\/\/moonrider7.com\/wp-content\/uploads\/2016\/02\/Building-300x163.jpeg\" alt=\"Building\" width=\"300\" height=\"163\" \/><\/p>\n<p class=\"p1\"><span class=\"s1\">She shared an example in Israel, which has a different system than in the US regarding how to ensure accessibility of buildings. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the US, a person has to sue to make a building accessible. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">But in Israel, the government has created a new certification for professionals who are trained to assess accessibility of buildings. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Before a building may open<span class=\"Apple-converted-space\">\u00a0 <\/span>one of these certified professionals have to go and assess the building to see if it complies with Israel\u2019s accessibility law. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">If it does, the professionals will recommend that the building can<span class=\"Apple-converted-space\">\u00a0 <\/span>open; if not, the building owner has to fix the accessibility problems before it can open. <\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">In the US, new and renovated buildings (except private homes) have to comply with the ADA Accessibility Standards. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">But unlike in Israel, there is no person who has to certify that the building meets accessibility standards before it can open. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">So after a building opens, if a person finds that it does not comply with the ADA standards, the person has to sue in court. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">That means<span class=\"Apple-converted-space\">\u00a0 <\/span>that buildings may remain inaccessible unless and until someone decides to sue, or until the owner decides to fix the problems voluntarily to avoid a future lawsuit. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Either way, ensuring accessibility may take time and additional costs to make a building accessible, especially after it has already been built.<\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">Professor Kanter reminds us that <\/span><\/p>\n<blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cLaws are only words on paper; they don\u2019t mean anything unless and until they are implemented.\u201d\u00a0<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-6812\" src=\"https:\/\/moonrider7.com\/wp-content\/uploads\/2016\/02\/equal-justice-under-law-300x163.jpeg\" alt=\"equal justice under law\" width=\"300\" height=\"163\" \/><\/p>\n<p class=\"p1\"><span class=\"s1\">In the area of employment, too, it is illegal to discriminate against people with disabilities in the US, but such discrimination continues. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The rate of unemployment for people with disabilities is nearly double the rate for people without disabilities in the US.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">And like the situation with buildings, if a person with a disability believes that he or she has been denied a job because of disability, the person has to go to court and prove discrimination under the ADA.<\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-6813\" src=\"https:\/\/moonrider7.com\/wp-content\/uploads\/2016\/02\/wheelchair-user-moonrider-300x199.jpg\" alt=\"wheelchair user moonrider\" width=\"300\" height=\"199\" \/>\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">In Japanese society, going to a court to sue is not as common as in the U.S. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">There is a huge gap between what laws regulate and what reality is. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In terms of employment for people with disabilities, the latest statistics updated in November 2015 by The Ministry of Health, Labour and Welfare of Japan shows that only 47.2% of targeted companies have met the <\/span><span class=\"s3\">quota*<\/span><span class=\"s1\">. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The quota is mandated by a law, but why more than half of companies chose to pay penalty instead of hiring people with disabilities?<\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\">Importantly, we can never solve an issue of unemployment for people with disabilities just by requiring the payment of a penalty.<\/p>\n<p class=\"p1\"><span class=\"s1\">If people with disabilities don\u2019t have a place to work, they would just stay at home and receive social welfare from the government. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">By doing so, some parents also would need to stay at home to take care of them.<\/span><\/p>\n<p class=\"p1\">In addition, we should notice the importance of manpower of people with disabilities, especially because Japan is losing young population today.<\/p>\n<p class=\"p1\"><span class=\"s1\">If we think of the country\u2019s total productivity and expense, hiring people with disabilities is a much better choice. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Laws are made to make a better society. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">We have to take them seriously, and enforce them, even if that takes hard work. <\/span><\/p>\n<p class=\"p1\">\u00a0<\/p>\n<p class=\"p1\"><span class=\"s1\">Reference:<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">*1.
